Your Rights

Know your rights.

If you are being questioned, detained, or arrested, these rights protect you.

Right to remain silent

You have the right not to answer questions. You must provide basic identifying information in some situations, but you are not required to answer questions about the alleged offense.

Right to an attorney

You have the right to have an attorney present during questioning. If you cannot afford one, one will be appointed. If you ask for an attorney, questioning must stop.

Right against unlawful search

You have the right to refuse consent to a search of your person, car, or home, unless police have a warrant or probable cause. Refusing consent is not an admission of guilt.

Right to know the charges

If you are arrested, you have the right to be told the charges against you and to appear before a judge promptly.
