What happens after an arrest.
Understanding the criminal process in Massachusetts — from arrest through resolution.
1. Arrest and booking
After an arrest, you are taken to a police station for booking. You will be photographed, fingerprinted, and asked for basic information. You have the right to remain silent and the right to an attorney.
2. Arraignment
Within 24 hours (or the next court day), you appear before a judge for arraignment. The charges are read, bail may be set, and you enter a plea. Having counsel at arraignment matters.
3. Pre-trial proceedings
Between arraignment and trial, there are pre-trial hearings, discovery, and often motions to suppress evidence. This stage is critical — many cases resolve here.
4. Trial or resolution
If the case does not resolve through negotiation or dismissal, it goes to trial. A jury or judge decides the outcome. We prepare every case as if it will be tried.
